"A RESEARCH-BASED STUDY OF THE SOCIAL RIGHTS OF PRISONERS IN THE LIGHT OF ISLAMIC TEACHINGS"

Abstract

This study examines the concept of the social rights of prisoners in Islam, highlighting the Islamic legal and ethical framework that safeguards the dignity and welfare of individuals deprived of liberty. It argues that imprisonment in Islam is not intended as a means of revenge or humiliation but as a corrective and rehabilitative measure aimed at reforming offenders and reintegrating them into society. The study explores the rights of prisoners to humane treatment, adequate food, clothing, healthcare, family contact, education, vocational training, legal representation, religious practice, recreation, communication with society, and access to appropriate media within the limits of public interest and prison discipline. It also discusses the juristic perspectives on prisoners’ marital rights, emphasizing the diversity of opinions among classical Islamic jurists. Furthermore, the study examines the ethical principles governing prison administration, including the separation of prisoners according to age, gender, and the nature of their crimes to prevent moral corruption and ensure effective rehabilitation. Drawing upon the Qur’an, the Sunnah, classical Islamic jurisprudence, and relevant contemporary legal principles, the paper demonstrates that Islamic law recognizes prisoners as bearers of fundamental human rights despite their conviction. It concludes that the Islamic model of imprisonment seeks to balance justice with compassion by protecting human dignity while promoting moral reform, social responsibility, and successful reintegration into the community.
